Stacey spoke about the importance of protecting private property rights when developing the management standard for aquifers during the joint planning process. Stacey informed her audience of groundwater conservation districts and stakeholders that Texas law requires districts to select a management standard for their aquifers that affords all groundwater owners an opportunity to produce a fair share of the resource. Stacey also spoke about how regulation that goes too far can give rise to a “taking” of private property in violation of the Texas and United States Constitutions.
